Submission by Ukraine having concerns about Romania’s compliance with its obligations under the Convention (EIA/IC/S/2)

Submission by Ukraine having concerns about Romania’s compliance with its obligations under the Convention, with respect to inland waterways in the Romanian Sector of the Danube Delta which permit the passage of vessels of over 1,350 tons.


At its 16th session (10-12 March 2009), the Implementation Committee agreed to consider the submission at its 17th session, held in Geneva on 14-18 September 2009 (ECE/MP.EIA/IC/2009/4). The Committee finalized its findings and recommendations further to the submission at its 18th session, 23-25 February 2010 (ECE/MP.EIA/IC/2010/2). The Meeting of the Parties in its 5th session:
  • Endorsed the findings of the Implementation Committee that Romania was not in non-compliance with the Convention in relation to the activities referred to in the submission by Ukraine regarding Romania on 6 March 2009 (ECE/MP.EIA/IC/2010/2, annex);
  • Urged the Governments of Romania and Ukraine to accelerate negotiations to cooperate in the preparation of a bilateral agreement or other arrangement in order to support further the provisions of the Convention, as set out in article 8 of the Convention, further to paragraph 14 of decision IV/2, and invite them in this context to consider extending the list of activities subject to the Convention in relation to the protection of the Danube Delta, and to introduce provisions on management and monitoring.
