International Seminar on Product Safety and Counterfeiting

5 - 6 November 2007

Geneva, Switzerland

The Seminar was organized by the Working Party on Regulatory Cooperation and Standardization Policies in cooperation with a number of intergovernmental, international and regional bodies and organizations.

The following organizations were represented: Interparliamentary Assembly of Member Nations of the Commonwealth of Independent (IPA CIS); Commonwealth of Independent States Interstate Council on Standardization, Certification and Metrology; World Intellectual Property Organization (WIPO), Organisation for Economic Co-operation and Development (OECD), and International Chamber of Commerce (ICC). The business sector was also actively involved.

The Seminar reviewed national and regional initiatives for the protection of consumers and the safety of users. The panellists explained how policies are operationalized into governmental controls at various levels, in particular as regards counterfeit products. Special emphasis was placed on the infrastructure needed at the national level. as well as on legal and economic implications, and the trade-restrictive impact.

Representatives of regional groupings and of national Governments engaged in regulatory activities, intellectual property rights protection and market surveillance also shared their experiences. They concluded by:

  • Noting the negative economic and legal implications of the infringement of intellectual property rights and in particular the danger which counterfeits and goods with counterfeit conformity-assessment marks can pose to consumers and users;
  • Reaffirming the major responsibility of public authorities in ensuring product safety and respect of intellectual property rights (in cooperation with the private sector);
  • Stressing the importance of establishing and promoting good practices in this area (for example, as proposed by the "MARS" Group and by its new recommendation "M", which encourages inter-agency cooperation on product safety and IPR matters on a national and regional level.
