Submission by Romania having concerns about Ukraine’s compliance with its obligations under the Convention with respect to the Danube-Black Sea Deep-Water Navigation Canal in the Ukrainian Sector of the Danube Delta (the ‘Bystroe Canal Project’).
On 19 August 2004 Romania requested the establishment of an inquiry commission under Article 3, paragraph 7, of the Convention, with respect to the same project. At its sixth meeting (3-5 November 2004), the Implementation Committee noted that, because of paragraph 15 of its structure and functions (described in the appendix to decision III/2, ECE/MP.EIA/6), it was not in a position to consider this submission (MP.EIA/WG.1/2005/3, para. 14).
The inquiry commission completed its work on 10 July 2006 and handed over its opinion on the environmental impact of the Bystroe Canal Project to the Ambassadors of Romania and Ukraine and to the Executive Secretary of the UNECE (the inquiry commission's report).
At its eleventh meeting (13-14 February 2007), the Implementation Committee agreed that a second submission by Romania (dated 23 January 2007) superseded Romania’s first submission, which was considered closed (ECE/MP.EIA/WG.1/2007/4, para. 23).

Submission by Romania having concerns about Ukraine’s compliance with its obligations under the Convention, with respect to the Bystroe Canal Project and in the light of the opinion of the inquiry commission on the environmental impact of the project.
At its eleventh meeting (13-14 February 2007), the Implementation Committee agreed to consider the submission at its twelfth meeting, to be held in Geneva on 26-28 June 2007 (ECE/MP.EIA/WG.1/2007/4, para. 23).
The Committee considered the matter at its twelfth (26-28 June 2007), thirteenth (30 October - 1 November 2007) and fourteenth (15-17 January 2008) meetings. See the Findings further to a submission by Romania regarding Ukraine (ECE/MP.EIA/2008/6) plus an addendum.
